The BIA's Regional Director, Dale Morris, announced his decision, March 24, 2009 concerning the September 20, 2008 General Council Meeting. The removal of Joe was decided to not be legal. The Indian Civil Rights Act was referred to in this decision. It states that Joe, and the General Councils right to due process were violated. It also stated that the civil rights of the members that signed the recall petition were also violated. The BIA in my opinion has looked at the constitution and rendered their last two decision based on the what the constitution says. This should have happened years ago. February 17 2009 Decision Morris blasts Kennedy's actions from the time he tried to throw out Ed, Ginger, and Lyle, up until the January 2008 meeting in Hesperia. Morris used our tribal constitution to pull the rug out from under Joe's feet, leaving him no defense for his blatantly irresponsible and tyrannical actions, which included attempts to seat his own tribal council, pass unconstitutional resolutions and conduct illegal elections.
